These Terms of Service were updated effective January 1st 2017.
These Terms constitute a binding agreement between You and Talent Boar and are deemed accepted by You each time You use or access the Site. If You do not accept the Terms stated here, do not use the Site or any of our Services.
1. Acceptance of Terms
Please read this Agreement carefully before accessing or using the Site. By accessing or using any part of the Site, You agree to become bound by the terms and conditions of this Agreement. If you do not agree to all terms and conditions of this Agreement, do not access the Site or use any of its services. Talent Board reserves the right to, in time, update the terms and conditions, so please refer to this Site page periodically to check for any updates.
2. Site and License Description
The Site provides information about Talent Board products and services. All text, images, and all other forms of content of the Site (the "Contents") are protected by the copyright laws . Talent Board grants you a license to view the Contents on the publicly accessible areas of the Site. This license does not include the right to screen scrape, reproduce, distribute, broadcast, modify or otherwise commercially exploit any of the Contents. The license can be terminated by Talent Board at any time with or without cause.
3. Site Modifications
Talent Board reserves the right to, at any time, modify the Contents or block access to the Site (or any part thereof), temporarily or permanently, with or without notice to You. You agree that Talent Board will not be liable to you for any modification, suspension or discontinuance of the Site or the Contents.
If you wish to terminate this Agreement or your Talent Board account (if you have one), you may simply Close Account or discontinue using the Site. Talent Board also reserves the right to terminate your access to all or any part of the Site at any time, with or without cause or notice, effective immediately. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, reward payment conditions, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
5. Site Usage Restrictions
Talent Board will take action to prevent the misuse of the Site for any unlawful or objectionable purpose. Accordingly, you agree not to use the Site for any unlawful or objectionable purpose, including, without limitation, use of the Site to post, upload, or transmit any Content that is:
1. unlawful under the laws of any jurisdiction to which you or Talent Board are subject;
2. harmful, threatening, harassing, defamatory, invasive of the privacy of another, or obscene (including, without limitation, any images or depictions of child abuse, child pornography, or minors engaged in sexual conduct or explicitly sexual situations);
3. insider information, or any other proprietary or confidential information;
4. an infringement of any patent, trademark, trade secret, copyright, or other intellectual property right;
5. falsified, including, without limitation, the use of forged headers or otherwise manipulated identifiers in order to disguise its origin;
6. containing or transmitting software viruses or any other malicious computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software;
7. to be used in any user rights’ claims actions;
8. an advertisement or solicitation for any products or services.
You agree to indemnify and hold Talent Board harmless from any liability incurred as the result of your violation of these Terms.
6. Agreement Changes
Talent Board reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Site following the posting of any changes to this Agreement constitutes acceptance of those changes. Talent Board may also, in the future, offer new services and/or features through the Site. Such new features and/or services shall be subject to the terms and conditions of this Agreement.
7. Disclaimer of Warranties
The Site is provided “as is”. Talent Board and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Talent Board nor its suppliers and licensors make any warranty that the Site will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain, content or services through the Site at your own discretion and risk.
8. Limitation of Liability
In no event will Talent Board, its suppliers, or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by You to Talent Board under this agreement during the twelve (12) month-period prior to the cause of action. Talent Board shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
9. General Representation and Warranty
You agree to defend, indemnify, and hold harmless Talent Board, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to any Talent Board Site, (ii) Your use of any Talent Board Content, or (iii) Your breach of these Terms. Talent Board shall provide notice to You promptly of any such claim, suit, or proceeding.
11. Job Offer Conditions
The hiring service , application reviewing and other features of the Site may be used only by individuals seeking employment and/or career information and by employers seeking employees. In addition, Talent Board may be used by individuals for permitted professional and personal networking purposes. Your use of our Services is also subject to any other contracts You may have with Talent Board. In the case of any conflict between these Terms and any contract you have with Talent Board, the terms of your contract will prevail. The term “post” as used herein shall mean information that You submit, publish, or display on the Site.
You are responsible for maintaining the confidentiality of Your account, Profile and passwords, as applicable. You may not share Your password or other account access information with any other party, temporarily or permanently, and You shall be responsible for all uses of Your registrations and passwords, whether or not authorised by You. You agree to immediately notify Talent Board of any unauthorised use of Your account, Profile, or passwords.
12. Content Conditions
The acceptance of the Agreement implies that You allow Us to edit job offer copy and company details as We see fit, using publicly available information and content provided by You. This level of curation is essential to keep the Site quality standards, and ensure clean and simple communication for candidate attraction.
The job offers You post on the Site will be available on our job listings and subscriptions for 30 consecutive days since the effective first date of publication. You can request an extension of this period before the 30 days or in the 15 days that follow the expiration of the job offer. We reserve the right to accept or defer Your request without further justification.
Talent Board also reserves the right to:
1. Promote, unpublish, edit, re-publish or close job offers at any moment, without notice and/or prior consent;
2. Share job offers in external channels such as job boards, partner websites, and social media (e.g. Facebook, LinkedIn and/or Twitter), with the sole purpose of increasing their reach.
Talent Board only allows the publication of job offers for fixed-term contracts when the contract length is, at least, 6 months. Regardless of contract length, You are always obliged to pay the full amount of the fee as described in Pricing Conditions.
13. Pricing Conditions
Talent Board offers 3 Pricing options( Check the pricing options), as an employer before you post any job you will be prompted select the pricing option that you prefer,our team will also contact you to ensure you understand the terms and sign any relevant contracts.
Value Added Taxes
All the previously mentioned fees are presented without VAT, which shall be charged when required by law.
When invoicing services billed in other currencies rather than KES, all charges will be calculated accordingly to the currency exchange rate at the invoice issue date.
14. Payment Conditions
By accepting this Agreement, You are bound to pay the fees associated with any of the services or products provided by Talent Board. The specific conditions for each product are detailed below.
15. Payment Methods and Late Payments
Payments to Talent Board can be done Cheque,Mpesa or Bank Trasnfer. You can specify your preferred payment method when posting a job offer on the Site.
For payments made after the due date, Talent Board is automatically entitled to interest( 5%of the invoice amount per month) for late payment and any legal costs that will be incurred in recovery costs.
16. Guarantee and Refunds
If, for some reason, You decide not to keep the new hire, or if the hire leaves the employer within a 90-day guarantee period after the candidate’s starting date, Talent Board will re-open or keep the job offer live until a new candidate is hired by the employer, at no extra cost( For only one replacement). However, Talent Board will not issue any refund.
17. Referral Rewards
Since referrers are a key piece of Our attraction efforts, Talent Board will pay a referral reward to the respective referrer. The referral rewards represent no extra cost for You.
There are two reward payment options available:
1. Referrer sends an invoice and bank account details to Talent Board. Talent Board will then transfer the amount.
2. Talent Board will send the referrer MPESA transfer with the corresponding referral value.
Talent Board will pay the reward within 60 days from the moment we collect the Hiring fee from the Employer, which will always take place after the start date of the candidate at the new job. The reward amounts are presented with VAT and may be subject to tax depending on the chosen payment method.

The Site contains links to third party Web sites. These links are provided solely as a convenience to You and not as an endorsement by Talent Board of the contents on such third-party Web sites. Talent Board is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third-party Web sites, You do so at Your own risk.
20. No resale or Unauthorized Commercial Use
You agree not to resell or assign Your rights or obligations under these Terms. You also agree not to make any unauthorised commercial use of any Talent Board Site.
Talent Board (“our”, “us” or “we”) knows that keeping your information private is extremely important. We are committed to protecting and respecting your privacy, and giving you control over any information we hold about you.
1. Site Visitors
Like most site operators, Talent Board collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Talent Board’s purpose in collecting non-personally identifying information is to better understand how Talent Board’s visitors use its Site. From time to time, Talent Board may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Site.
Talent Board also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. Talent Board only discloses logged in user IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

Certain visitors to Talent Board’s Site choose to interact with Talent Board in ways that require Talent Board to gather personally-identifying information. The amount and type of information that Talent Board gathers depends on the nature of the interaction. In each case, Talent Board collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Talent Board. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain site-related activities.

Talent Board discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Talent Board’s behalf or to provide services available at Talent Board’s Site, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Talent Board’s Site, you consent to the transfer of such information to them.
Talent Board will not share with or sell your potentially personally-identifying information to other organizations for commercial purposes, except when we have your permission to provide you products or services that you’ve requested. If you are a registered user of a Talent Board Site and have supplied your email address, Talent Board may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Talent Board and our products. We primarily use our blog to communicate this type of information. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Talent Board takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
5. Business Transfers
If Talent Board, or substantially all of its assets were acquired, or in the unlikely event that Talent Board goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquiror of Talent Board may continue to use your personal information as set forth in this policy.
